TERMS OF SERVICE

1. Accepting Terms

This document sets out your rights and responsibilities when you use Rednur.com and our mobile app. If you don’t agree with the Terms, you may not use our Services.

 

2. Your Privacy

We understand that your personal information is important to you, therefore we treat it accordingly. When you use our Services, our Privacy Statement explains how your information is collected, utilized, and shared. By using our services, you also consent to our use of your information in accordance with our Privacy Statement, so please review it here.

Under US law, Rednur and sellers are each deemed separate and independent data controllers of buyers' personal information because they both process members' personal information (such as buyer name, email address, and delivery address). Consequently, each party is responsible for the personal information it processes in the provision of the Services. For instance, if a vendor inadvertently exposes a buyer's name and email address while fulfilling another buyer's order, the seller, and not Rednur, will be liable for the illegal disclosure.

 

3. Your Account on Rednur

You’ll need to create an account on Rednur.com to use some of our Services. Here are a few rules about accounts with Rednur:

You must be 18 to utilize our services. Minors under 18 and at least 13 can only use our Services with a parent or legal guardian's permission and supervision. Under-13s can't utilize Rednur or the Services. You are responsible for a minor's account behavior on your account. You may want to examine commercial products or services to limit a minor's internet access.

Be honest. Describe yourself accurately. You can't use incorrect information or impersonate someone else on your account.

Choose a name. If you don't use your full name, you can't use offensive, profane, or otherwise illegal language.

It's your account. Your account's activity is your responsibility. The person whose financial information is on the account is accountable for all activity. If you're registering as a business, you ensure you have the authority to agree to the Terms. Accounts aren't transferable.

Password-protect it. You're responsible for all account activity, so keep your password secure.

These Terms do not form an agency, partnership, joint venture, employment, or franchisee relationship.

 

4. Your Content

Your Content is the content you upload using our Services. We don't claim anything you publish using our Services (like shop names, profile pictures, listing photos, listing descriptions, reviews, comments, videos, usernames, etc.).

A. Content responsibility. You own Your Content. You represent that you own all rights to Your Content and that uploading it doesn't violate any third-party rights.

B. Content Permission. You offer Rednur a license to use Your Content by uploading it through our Services. We don't own Your Content, but we can use it to build Rednur. So, we won't infringe on your rights and can promote Your Content.

C. Rednur's rights. By uploading Your Content, you give Rednur a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, permanent license to use, display, edit, alter, reproduce, distribute, store, and generate derivative works. This permits us to deliver the Services and advertise Rednur, your Rednur shop, or the Services in any format or channel, including across Rednur Services, our partners, or third-party websites or advertising mediums. You won't assert moral or publicity rights against us for using Your Content. You also acknowledge our legitimate interest in using it if Your Content contains personal information.

D. Content Reporting. Rednur respects intellectual property rights and follows legal procedures to remove the unauthorized content.

E. False or misleading content. Certain content shouldn't be placed on Rednur's Services (for legal reasons or otherwise). You won't post abusive, threatening, defamatory, vulgar, or deceptive information.

 

5. Your Use of Our Services

Permission to Utilize Our Services. We grant you a limited, non-exclusive, non-transferable, and revocable license to use our Services, subject to the Terms and, in particular, the following restrictions:

Do not use our services to commit illegal acts. You agree that your use of the Services will not violate any applicable laws. This includes all applicable local, state, federal, and international legislation.

It is your responsibility, for instance, to get any licenses or licenses that your shop requires and to comply with applicable legal requirements in the applicable jurisdiction (s). This includes the sale and delivery of your products, including age verification at the time of delivery if required by law. You may not sell anything that violates the law, nor may you engage in fraud (including false claims or infringement notifications), theft, anti-competitive behavior, threatening behavior, or any other unlawful acts or crimes against Rednur, another Rednur user, or a third party.

 

6. Termination

You cancel. You can cancel your Rednur account in settings. Some of Your Content you provided through the Services before canceling will remain available. Invoices must be paid.

Rednur's dismissal If we suspect you, your Content, or your use of the Services breaches our Terms, we may terminate or suspend your account (and any related accounts) and your access to the Services. If we do, you have no contractual or legal right to use our Services, such as selling on our websites or mobile apps. Rednur will notify you when your account is terminated or suspended unless you have repeatedly broken our terms or we have legal or regulatory grounds to withhold notice.

If you or Rednur terminate your account, you may lose your content.

Rednur may change, suspend, or discontinue the Services for any reason, including those specified in these Terms of Service. We're not responsible for how changes to the Services affect your revenue or ability to make money through them.

 

7. Limitation of Liability

Items You Purchase. You understand that Rednur does not manufacture, store, or inspect any of the items sold through our Services. We provide the venue; the items in our marketplaces are produced, listed, and sold directly by independent sellers, so Rednur cannot and does not make any warranties about their quality, safety, authenticity, or their legality. Any legal claim related to an item you purchase must be brought directly against the seller of the item. You release Rednur from any claims related to items sold through our Services, including for defective items, misrepresentations by sellers, or items that caused physical injury (like product liability claims).

Content You Access. You may come across materials that you find offensive or inappropriate while using our Services. We make no representations concerning any content posted by users through the Services. Rednur is not responsible for the accuracy, copyright compliance, legality, or decency of content posted by users that you accessed through the Services. You release us from all liability relating to that content.

People You Interact With. You can use the Services to interact with other individuals, either online or in person. However, you understand that we do not screen users of our Services other than to meet certain compliance and legal obligations, and you release us from all liability relating to your interactions with other users. Please be careful and exercise caution and good judgment in all interactions with others, especially if you are meeting someone in person.

 

8. Warranties

Rednur is committed to providing the finest services possible. We fully disclaim any and all warranties, including title, non-infringement, merchantability, and fitness for a particular purpose, as well as any warranties implied by a course of performance, course of dealing, or trade practice.

We do not promise that:

1. the services will be secure or available at any certain time or location;
2. any faults or errors will be rectified;
3. the services will be free of viruses or other harmful materials;
4. the results of using the services will match your expectations.

 

You only use the services at your own risk. Because certain jurisdictions do not allow implied warranty limits, the following limitations may not apply to you.

Limits of liability․

To the maximum extent permissible by law, neither Rednur nor our employees or directors will be liable to you for

1.  any lost profits or revenues,
2.  any consequential, incidental, indirect, special, or punitive damages arising out of or in connection with the services or these conditions.

 

9. Disputes with Other Users

If you find yourself in a dispute with another user of Rednur, we encourage you to contact the other party and try to resolve the dispute amicably.

Release of Rednur. You release Rednur from any claims, demands, and damages arising out of disputes with other users or parties.

 

10. Disputes with Rednur

Tell us if you're dissatisfied, and we'll try to help. If not, following rules govern any legal issue regarding our Services:

A. Governing Law. The Terms are governed by the laws of California and the U.S. These regulations apply everywhere, however if you live outside the U.S., you may be protected by your local consumer protection law's required clauses.

Arbitrage. You and Rednur agree that any dispute or claim arising from or relating to the Terms shall be finally settled by final and binding arbitration, using the English language, administered by the American Arbitration Association (the "AAA") under its Consumer Arbitration Rules (the "AAA Rules") then in effect (those rules are incorporated by reference into this section, and as of the date of these Terms, you can find the AAA Rules here). **A sole arbitrator will handle arbitration, including threshold questions of arbitrarily, per these rules. Any court with jurisdiction can rule on the arbitral award.
